Fabian faced charges related to the tragic death of his dog, Jasper, and the severe malnutrition of another. Despite the seriousness of these offenses, he pleaded guilty to three misdemeanor charges and received a 90-day suspended jail sentence, contingent upon completing five years of probation, during which he is barred from owning dogs.
The public reaction has been overwhelmingly critical, with many believing the sentence does not reflect the gravity of the crime. Social media exploded with comments expressing dissatisfaction with the legal outcome, following journalist Bob Pockrass’s post announcing the news.
Critics voiced strong disapproval, with Dustin Smrekar posting, “Give him the same treatment he gave those dogs,” and Zoniax stating, “90 freaking days and 5 years of probation is way too lax for animal abuse.” Another user, Beverly Levay, commented, “Should have been 90 years!” Such remarks reveal widespread anger and disappointment, with many feeling this was a gross miscarriage of justice.

NASCAR journalist Pockrass noted that the organization is taking the situation seriously and continues to investigate. Fabian, who has held the role of Cup Series director since January 2019 overseeing technical compliance, was suspended following the allegations in 2021.
This situation has reignited discussions around sports organizations’ ethical responsibilities regarding personal conduct issues. Many believe this incident highlights the need for transparency and stronger regulatory practices within sports organizations. Critics argue that the legal system frequently fails to provide adequate justice in such cases, spurring calls for stricter animal protection laws.
